These Terms and Conditions (“Terms”) govern your use of the website and services provided by Publishing and Marketing House LLC (“Service Provider,” “we,” “us”). By accessing or using our services, you agree to be bound by these Terms.

1. Services and Intellectual Property

  • Service Agreement: Upon agreement of a quote and payment, we will deliver the specified publishing, editing, design, or marketing services as outlined in your individual Service Agreement or Project Proposal.
  • Intellectual Property (IP): You retain 100% of the copyright and intellectual property rights to your manuscript and published book. Our work is deemed a “work-for-hire,” and we make no claim of ownership over your creative content.
  • Client Representation: You represent and warrant that you own or have the necessary licenses and rights to any content (manuscripts, images, data) provided to us, and that this content does not infringe upon any third party’s rights.

2. Payments, Pricing, and Refunds

  • Payment: All prices are quoted and charged in U.S. Dollars (USD). Payment terms are specified in your individual Service Agreement. Services commence only after the initial required payment is successfully processed.
  • Payment Processing Compliance: We use secure third-party payment processors. By submitting payment information, you warrant that the provided information is accurate and that you are authorized to use the designated payment method. You agree to resolve any payment disputes directly with the processor before engaging us.
  • Refund Policy (Aligned with Payment Processor Requirements):
    • Prior to Work Commencing: You may cancel a service agreement and receive a full refund of any payments made, provided the assigned contractor has not yet commenced billable work.
    • After Work Commencing: If work has begun, cancellation is subject to a partial refund based on the percentage of the work completed, as determined by the Service Provider. The completed portion will be billed at our standard rate, and the remainder will be refunded.
    • Completed Work: No refunds will be issued for services that have been fully completed and delivered, including completed editing, design files, or executed marketing campaigns.

3. Digital Advertising and Marketing Services (Google/Facebook Ads)

  • Client Account Access: For marketing services, you agree to grant us necessary admin/manager access to your advertising platforms (e.g., Google Ads, Facebook Ads Manager) for the sole purpose of campaign management and optimization.
  • Budget Management: You are solely responsible for funding and maintaining the necessary advertising budget on the third-party platforms (Google, Facebook). We are responsible only for the management fees specified in our agreement.
  • Compliance: You agree that all book content and landing pages associated with the advertising campaigns will comply with the policies of Google Ads, Meta (Facebook/Instagram), and all other relevant advertising platforms. We reserve the right to pause or terminate any campaign that may violate these third-party policies.

4. Limitation of Liability

We guarantee that our services will meet professional industry standards. However, we do not guarantee the ultimate commercial success, sales volume, or financial performance of your book or advertising campaigns. Our liability for any claim related to the services shall be limited to the amount of the fees paid by you for the specific services in question.

5. Governing Law and Contact
